DEREK DAVIES OF KIRKCALDY SENTENCED FOR POSSESSING INDECENT IMAGES OF CHILDREN IN DUNFERMLINE

A former resident of Cardenden has been sentenced to 150 hours of unpaid work after being found guilty of possessing indecent images of children. Derek Davies, aged 60, of Bennochy Avenue in Kirkcaldy, committed these offences between 14 September 2010 and 13 August 2013 at both his current address and his previous residence on School Lane, Cardenden, Dunfermline Sheriff Court was told on Wednesday.

Fiscal depute Siobhan Monks stated, “The police crime unit received information that a device registered to the accused was involved in sharing files containing indecent images of children. The accused was subsequently interviewed and made no comment.

“A total of 43 videos, ranging from level one to level five, involving female children aged between 11 and 15 years old, were discovered. These videos depicted the children engaging in sexual acts with adults and animals.”

Davies’ legal agent, Toni Pentecost, explained, “My client initially encountered these images while accessing adult pornography. He recognizes he needs help and hopes the Court can assist him in that regard.

“This case has caused him to reflect on his behaviour.

“His previous address was near a school, but he has since moved to alleviate concern from the community and local parents.

“Mr Davies feels ashamed and embarrassed. He understands that his actions have not only affected him but also the children involved.

“He accepts that a custodial sentence may be considered today. Despite his remorse, he has family members who support him, even though they do not agree with what he has done. They have promised to stand by him.”

Sheriff Craig McSherry stated, “As an alternative to a custodial sentence, you will be placed on a 24-month supervision requirement order with conditions. These include no contact with children under 16 unless approved by your supervision officer, and monitoring of your internet access devices.”
