DISABLED MAN ATTACKED WITH EXTENSION CABLE IN TOP VALLEY
A disabled person had an extension cable wrapped around his throat and pulled tight after his attacker walked into his flat, a court heard.Described as "very ill" and retired, the victim had encountered acquaintance David Roe previously when he spoke to him horribly and threatened him.Roe went into the man's flat, in Rise Park, when he had been asleep on the sofa on January 9 this year.Roe said "you don't know me, I'm a nutter, I'll kill you," Nottingham Crown Court was told on Wednesday, February 26.
The man hit his emergency buzzer and told the security services he did not want the man there.Roe grabbed him and headbutted him and pulled his face towards him and he felt a bite on his ear.
He was then kicked and punched all over his body and face.
The man then saw Roe, 42, of Benedict Court, Top Valley, reach for the extension cable and wrap it around his throat and pull it tight.
He thought he was trying to kill him and did not know how long the cable around his neck was before he managed to get Roe off him.
He escaped and police were called.
In a statement the victim said he was "really shook up" and wanted to move away from where he lived.
Roe - a man with 43 convictions on his record for 143 offences, including six against the person - pleaded guilty to assault, causing bodily harm.
Judge James Sampson gave him 12 months in prison, which will start today (February 26), so the new sentence should not add to the current term he is serving.
If there had been a trial, the judge said the sentence, consistent with the guidelines, would have been 18 months.
But he said Roe had pleaded guilty and he received full credit for that.
He will be subject to a restraining order for three years.
"You kicked and punched him and put electrical cable around his throat.
Fortunately, his injuries were not significant," the court was told, in mitigation, that Roe is ashamed of himself.
He started drinking and has limited recollection of it.
His licence period ends on December 21, 2021.
