MAN FROM ASH VALE FOUND GUILTY OF RAPING SLEEPING WOMAN
A 27-year-old man from Ash, Daniel Band, has been sentenced to five years in prison after being convicted of rape.The incident occurred during a night out in Aldershot when Band met the victim along with a friend on Saturday, December 14, 2013.
The trio eventually went back to Band's residence on Avondale at approximately 3 a.m.
on Sunday, December 15.
There, they consumed more alcohol and reportedly all fell asleep on the sofa.
During the trial, Band, who denied one count of anal rape, faced prosecution.
Prosecutor Christopher May addressed the jury at Guildford Crown Court on Monday, February 8.
He explained that at one point during the evening, the victim awoke and went outside to smoke a cigarette.
Mr.
May stated, "When she returned from smoking, the two men were asleep.
She then went back to the sofa and fell asleep herself." The court noted that there had been no indication of any sexual talk, foreplay, or similar behavior prior to this event.
Additionally, the victim's friend left the house, leaving her alone with Band in the living room.
