    Benjamin Samuel Avill, born on 26 November 1982 and residing on Waltham Road in Bournemouth BH7 6PE, was convicted in 2019 for a disturbing act of revenge that involved poisoning a collection of tropical fish. The incident took place in Boscombe, a seaside suburb of Bournemouth, where Avill’s actions caused significant distress and harm.

    According to court reports, Avill’s violent outburst was triggered when his former partner, Jenny Daniels, informed him that their 12-year relationship had come to an end. Overcome with rage, Avill seized a nearby bottle of Comfort fabric conditioner and poured its entire contents into a large fish tank that housed fifty tropical fish. Witnesses described how Avill laughed as he carried out the act, seemingly deriving some twisted amusement from the suffering he was about to cause.

    Tragically, the poisoning resulted in the death of all but one of the fish. The sole survivor, a bristlenose pleco named Bob, was rescued and now resides with Miss Daniels. She reported the incident to the RSPCA, which led to Avill’s arrest and subsequent court proceedings. It was revealed that Avill had a prior conviction for drink driving, adding to concerns about his behavior and character.

    The court heard detailed testimony from Matthew Knight, the prosecutor representing the RSPCA. He emphasized the severity of the crime, stating, “In the eyes of the general public, if he had done this to 49 dogs, the outcry would be significant. However, the act does not differentiate between protected animals.” Knight explained that the fish would have experienced considerable suffering during the poisoning, which involved pouring a three-litre bottle of fabric conditioner into the tank. An expert witness confirmed that the fish would have died an acute and unnecessary death, highlighting the cruelty involved.

    It was also noted that the fish were jointly owned by Avill and Miss Daniels, and that their argument had escalated into this tragic act of violence. The court was told that Avill showed little remorse for his actions, which resulted in the suffering and death of numerous innocent creatures. The prosecution underscored the inhumane nature of the act and the importance of holding Avill accountable.

    In mitigation, Leah Dillon argued that Avill’s behavior was out of character and that the incident was the culmination of several years of turbulent relations. She described him as “like a bottle of champagne which his partner was shaking and waiting for the cork to pop,” suggesting that his actions were impulsive and driven by emotional distress. Dillon claimed that Avill had expressed genuine remorse for his conduct.

    Ultimately, the court sentenced Avill to a 14-week prison term, which was suspended for 12 months. He was also ordered to pay costs of £400, complete 200 hours of unpaid work, and participate in 20 days of rehabilitation activities. Additionally, Avill was banned from keeping any animals for a period of 10 years, with the ban set to expire in September 2029. This case highlights the serious consequences of animal cruelty and the importance of enforcing animal protection laws in the Bournemouth area.
