MORAY DOMESTIC ABUSER TOLD HE’S LUCKY WIFE IS MORE PATIENT THAN COURT
Domestick abuser Stuart McLean was told that he could not go on causing harm to others because of his own problems at Elgin Sheriff Court.Stuart McLean appeared in the dock at Elgin Sheriff Court, when he was sentenced for assaulting his partner during a row concerning his drinking.
The 56-year-old, who has two previous convictions for behaviour of the same nature, had been after more alcohol when the argument broke out and accused the woman of messaging other men.
He will now be forced to seek counselling for his behaviour – or go to jail.
Abuser reacted violently The court heard that McLean, whose address was given as Back Street in Cummingston, had struggled with alcohol misuse and, as he stood in the dock on Thursday, was seven weeks sober.
He reacted violently on December 31 last year, however, when his wife refused him more drink.
Fiscal depute Sarah McNeill said the couple had been arguing all day over the issue.
“At about 9pm on the same date, [they] were within their home address,” she said.
“[She] was sat on one of the couches in the living room.
The accused was also in the living room and started nipping at [her], asking who she was messaging on her phone and stating she had someone else.” McLean would continue, eventually approaching the woman and grabbing both of her wrists “forcefully”.
Ms McNeill said the woman would report that she was “begging” him to stop as she was being hurt.
“It was causing her to nearly cry,” the fiscal depute added.
“During this, the accused has shouted at the witness saying ‘who the f*** you messaging’ and ‘you must be f****** seeing someone’.” McLean would go on to take his partner’s mobile phone before the police were contacted and he was arrested.
Officers noted the woman had a swollen right wrist and was visibly upset.
McLean would tell officers “it didn’t happen” when charged.
The court heard Stuart McLean already had convictions of a similar nature.
