A 19-year-old man named Spencer Smith committed a disturbing sexual assault that left a 14-year-old girl vulnerable in the cold snow after violently raping her in wooded countryside in North Lanarkshire.

The incident took place in Newmains on the night of February 1, 2019, when Smith preyed upon his young victim. According to court proceedings, the girl, who was under the influence of alcohol, had been attending a hen do celebration. She had consumed a significant amount of alcohol and later described feeling dizzy and woozy, demonstrating her impaired state.

Following the festivities, the teenage girl decided to leave the nearby Robin's Bar to meet Spencer Smith and an unidentified friend. The group then made their way into the woods known locally as The Bing, located behind the pub, around midnight. It was in this isolated area that the assault occurred. The court heard that the victim initially attempted to resist Smith’s advances by kicking him away, but he overpowered her. During the attack, Smith left her in the snow without her trainers, making her vulnerable to the cold and further danger.

Fortunately, the girl was able to call emergency services, which led to her rescue and medical examination. Police officers arrived at the scene to find her in an distressed, heavily intoxicated state. She was later determined to be three times over the legal limit for alcohol consumption related to drink-driving regulations.

In court, prosecutor John McElroy highlighted the gravity of the offense, stating, “Spencer Smith had sex with a drunk child. She tried to push him off by kicking him.” The court was told how the girl’s cries for help and her subsequent call to 999 played a crucial role in identifying the severity of the crime. The court heard evidence that Smith was aware that the girl was unable to consent due to her intoxication but continued with his actions regardless.

Smith, who hails from Wishaw, insisted during his trial that the sexual activity was consensual. However, police and toxicology reports pointed to the influence of alcohol impairing her judgment and capacity to consent. The prosecutor also argued that Smith’s knowledge of his victim’s condition did not justify his actions.

Throughout the trial, Smith broke down in the courtroom following his conviction of a single charge of rape. Members of the public gallery also appeared visibly upset. As he was led away into custody, he was heard to mutter “absolute a joke.” The judge announced that Smith would be placed on the sex offenders register for an indefinite period, with the precise length of registration to be decided at sentencing.

This case has sent shockwaves through the Lanarkshire community, raising concerns about safety and the prevalence of alcohol-fueled assaults, especially targeting vulnerable young girls in the area.
