In July 2018, a man named Sebastian Gasulla from Sole, Jersey, was sentenced to a two-year prison term following his conviction for multiple offences related to his interactions with underage girls and violations of court orders. The Royal Court heard that Gasulla-Sole, aged 33, was identified as a sex offender who posed a significant risk of reoffending, particularly with teenage girls, and was known to have a predilection for this age group.

Gasulla-Sole pleaded guilty to breaching a court restraining order that explicitly prohibited him from being alone with minors, as well as to charges of purchasing alcohol for underage individuals and committing three separate motoring offences. The court was informed that earlier this year, police officers discovered Gasulla-Sole in his flat with two underage girls, one of whom was a minor, and another teenager. Additionally, two 17-year-old girls were found waiting outside the premises.

These police actions were prompted by a neighbour who, aware of Gasulla-Sole’s probation status due to previous sex offences, called authorities to report suspicious activity. The neighbour’s intervention led to the police investigation and subsequent arrest. The solicitor general, Mark Temple, detailed that Gasulla-Sole’s criminal record included a 2015 conviction for six counts of unlawful sexual intercourse with a juvenile, relating to offences committed in 2004 and 2005 when he was 20 years old.

During the investigation, Gasulla-Sole initially claimed he was unaware of the girls’ ages. However, evidence revealed that he had taken them to purchase vodka at a local shop and had asked the shopkeeper whether they sold large condoms, indicating awareness of their youth. Further, it was disclosed that Gasulla-Sole had exchanged messages with one of the underage girls, describing her as ‘fit’ and possessing ‘a very nice sexy body,’ while also offering her drugs and suggesting they go out for dinner.

The neighbour who observed the girls outside Gasulla-Sole’s flat attempted to warn them off but ultimately contacted the police for assistance. The court noted that Gasulla-Sole, who has a borderline learning disability and a very low IQ, provided inconsistent statements to law enforcement. He claimed that his inquiry about condoms was made ‘as a joke’ and that the girls had approached him to ask for alcohol, which he had supplied under their persistent requests. He also refused to grant police access to his Facebook account during the investigation.

Since May 8, Gasulla-Sole has been in custody, having pleaded guilty to all five charges in the Royal Court. A social inquiry report presented to the court described him as being at a high risk of reoffending, with an especially very high risk of sexual reoffending. The report highlighted his engagement in risk-taking behaviours, his lack of empathy for his victims, and his failure to consider the consequences of his actions.

In sentencing, Deputy Bailiff Tim Le Cocq emphasized the court’s duty to protect vulnerable young girls from harm. Gasulla-Sole was sentenced to 18 months in prison for the most serious offence—breaching the court order not to be alone with minors. Additionally, he received a concurrent six-month sentence for purchasing alcohol for minors. For his motoring offences—using a dangerous vehicle, driving without insurance, and operating an unregistered vehicle—he was sentenced to an additional six months, to be served consecutively. This brought the total prison sentence to two years.
