SCOTT MARINI HYND SENTENCED IN UPHALL FOR SEXUAL ASSAULT ON SLEEPING TEENAGER
A 20-year-old man named Scott Marini, also known as Hynd, has been convicted and sentenced to a prison term of 40 months following his involvement in a disturbing sexual assault case that took place in Uphall, West Lothian. The incident involved an 18-year-old student who was the victim of a serious and non-consensual act while she was asleep at her home.According to court reports, the assault occurred during a period when the young woman was resting after watching Netflix with Marini at her residence in Uphall. She was in a vulnerable state, unable to give consent at the time of the incident. During the assault, Marini engaged in sexual activity with the sleeping girl, who only later woke up to find herself in pain. She also noticed that her T-shirt had been pulled up, exposing her breasts, which added to her distress and sense of violation.
Following the assault, Marini did not immediately leave the scene. Instead, he jumped from the teenager’s bed, sat at a nearby desk, and wrote her a note that read, "I am sorry and I know that isn't good enough." In the note, he also warned her that if she chose to tell anyone about what had happened, it would be considered 'fair,' but he implied that he would not report the incident himself, suggesting that doing so might 'ruin him.'
Further complicating the case, Marini later sent additional messages to the victim, in which he acknowledged his wrongdoing. He admitted that he was aware his actions were wrong and expressed regret for not stopping immediately. During the proceedings, it was revealed that Marini suffers from Asperger's Syndrome and ADHD. However, the court determined that these conditions did not significantly influence his criminal behavior, which was characterized as opportunistic and impulsive.
The judge, Lord Uist, emphasized the profound impact the assault had on the victim’s mental health and emotional well-being. As part of his sentence, Marini was placed on the sex offenders register indefinitely. He was also ordered to serve a prison term of three years and four months, a reduction from the original five-year sentence that would have been imposed if he had been convicted after a trial. This reduction was granted because Marini had entered an early guilty plea.
The court proceedings confirmed that the assault and rape took place on March 15 of the same year, with Marini admitting to the charges. Throughout the case, he expressed remorse and regret for his actions, acknowledging the gravity of what he had done. The case serves as a stark reminder of the serious legal consequences associated with sexual offenses, especially those involving non-consensual acts committed against vulnerable individuals. It also underscores the importance of protecting victims and ensuring justice is served in cases of sexual violence.
