    In July 2022, a disturbing case involving Kenneth McDonald, a resident of Wexford town, reached a significant legal conclusion after he failed to overturn his conviction for heinous crimes committed against his then-girlfriend's seven-year-old sister. The case, which spanned several years and involved multiple allegations of sexual assault, has left a lasting impact on the victim and the community alike.

    Kenneth McDonald, aged 56 at the time of the trial, faced serious charges including the rape and indecent assault of a young girl in various locations across County Wexford. The incidents reportedly took place over a period stretching from January 1987 to November 1994. McDonald maintained his innocence, pleading not guilty to all charges, and insisted that he had no involvement in the alleged crimes.

    Following a comprehensive trial at the Central Criminal Court, a jury found McDonald guilty of the charges. The court proceedings revealed the disturbing nature of the allegations, which included multiple instances of sexual abuse against the young girl. In October 2019, Mr. Justice Alex Owens sentenced McDonald to seven years in prison, reflecting the gravity of the offenses.

    Subsequently, McDonald sought to challenge his conviction through an appeal, claiming that he had not received a fair trial. His primary argument centered on the assertion that the trial judge, Ms. Justice Isobel Kennedy, had excessively interrupted the cross-examination of the complainant, allegedly more than 200 times. McDonald's legal team argued that these interruptions compromised his right to a fair hearing, and they also contended that the judge erred in refusing a request to provide the jury with a corroboration warning before they deliberated on their verdict.

    In legal terms, a corroboration warning is a judicial instruction to the jury emphasizing the importance of corroborative evidence in sexual assault cases, which are often based on the testimony of a single witness. The absence of such a warning can be a point of contention in appeals, especially in cases involving sensitive allegations.

    However, in a detailed judgment issued on the Monday following the appeal hearing, the Court of Appeal dismissed McDonald's challenge. Ms. Justice Isobel Kennedy, sitting alongside Mr. Justice John Edwards and Mr. Justice Patrick McCarthy, clarified that the trial judge's interventions were aimed at ensuring clarity and fairness during the proceedings. The interventions, she explained, were made to clarify questions, address instances where the witness appeared to misunderstand, or to correct questions that were rolled into a single inquiry, thereby maintaining the integrity of the trial process.

    Ms. Kennedy emphasized that the interventions did not render the trial unfair. Regarding the issue of the corroboration warning, she noted that Section 7 of the Criminal Law (Rape) (Amendment) Act 1990 grants the trial judge discretion to decide whether such a warning is necessary. The court found that the judge exercised this discretion conscientiously and carefully, and that there was no basis to interfere with this decision.

    During the appeal hearing in March, McDonald's counsel, John Peart SC, revealed that he only fully appreciated the extent of the judge's interruptions after reviewing the trial transcript. He stated that he did not wish to criticize the judge but believed it was appropriate to bring the matter before the appellate court for review. The prosecution, represented by Michael Delaney SC, pointed out that no issues had been raised by the defense regarding the judge's conduct during the trial, and many of the interventions were simply to ensure the witness's statements were heard clearly.

    The case also included a harrowing victim impact statement, in which the young girl, who waived her right to anonymity, described the profound and lasting effects of the abuse. She recounted feelings of terror, shame, and confusion, and detailed how the trauma had devastated her childhood and continued to affect her adult life. She expressed that her sense of self-worth had been stripped away, but also identified herself as a survivor, emphasizing her resilience despite the suffering.

    Garda Ian Doyle provided testimony about the timeline of the abuse, revealing that the first incident occurred during the summer shortly after the girl had started primary school. The offender entered her bedroom, molested her, and made disturbing comments such as “you will enjoy it.” Additional assaults included a rape in the evening and molestation while she was babysitting, with the final incident occurring when she was around 13 or 14 years old, when McDonald approached her from behind and inappropriately touched her while she was cleaning her brother’s car.

    During the trial, McDonald testified that he had never been upstairs in the victim’s house unless accompanied by her sister, and he denied ever babysitting for them. Despite his claims, the evidence against him was compelling, and the court found him guilty of multiple counts of sexual assault, leading to his imprisonment and subsequent unsuccessful appeal.
