TILBURY SEX OFFENDER KENNETH KIRK CAUGHT WITH EXTREME PORNOGRAPHY AND VIOLATED SEXUAL HARM PREVENTION ORDER
In January 2019, Kenneth Kirk, a known sex offender from Tilbury, faced serious legal proceedings at Basildon Crown Court following the discovery of disturbing and illegal content on his mobile device.The case drew attention due to the nature of the images found and the circumstances surrounding his previous convictions.
Police executed a search warrant at Kirk’s residence on March 8, 2018, during which they seized an iPhone that contained three highly disturbing images.
These images depicted male genitalia being subjected to what the court described as "serious harm" and torture.
Such content directly contravened the terms of a Sexual Harm Prevention Order (SHPO) that Kirk had been subject to since November 2015, which prohibited him from possessing or viewing certain types of images, including extreme pornography.
Kirk, aged 51, had a criminal history that included a previous jail sentence in 2015 for multiple offences, notably the possession of indecent images of children.
The court was informed that he had pleaded guilty on November 8 of the previous year to three charges: breaching his SHPO, publishing an obscure article online, and possessing extreme pornographic images.
Further investigation revealed that Kirk’s device contained cookies indicating he had accessed websites related to illegal content, despite having deleted his internet search history.
The search terms found included phrases such as "innocent girls" and "lil girl’s porn," raising suspicions about the nature of his online activity.
Prosecutor Charlotte Davison pointed out that the deletion of his browsing history could be an attempt to conceal illicit activity.
During police interviews, Kirk claimed that he was conducting research on "cock and ball torture" (CBT) after engaging in online conversations with a man a year prior.
He stated that the man had offered to pay him to participate in CBT, and that he was merely trying to learn how to do it safely before sending the images to the individual.
Kirk insisted that he did not believe the images were extreme because they reflected his personal preferences, although he acknowledged that others might view them differently.
He also maintained that he only viewed legal pornography websites.
However, the prosecution highlighted concerns about his actions, emphasizing that his deletion of internet history suggested an attempt to hide illegal activity.
The court was also reminded of Kirk’s earlier conviction and jail term for similar offences.
At the sentencing hearing, Judge Ian Graham addressed Kirk directly, stating, "You have pleaded guilty to three offences.
Extreme images were found on your phone.
These offences can and often do lead to immediate custody, but one must always look to the possibility of rehabilitation." The judge emphasized the importance of obeying the conditions of the SHPO and warned Kirk that failure to do so would result in imprisonment.
As part of his sentence, Kirk was handed a three-year community order, which includes a rehabilitation activity requirement for 60 days and 100 hours of unpaid work.
Additionally, he was ordered to register as a sex offender for five years.
The court’s decision underscored the seriousness of his violations and the ongoing risk posed by his actions, while also providing a pathway for potential rehabilitation.
