SAUGHALL SEX OFFENDER JAILED FOR BREACHES AT CHESTER CROWN COURT
A Saughall man’s streak of bad luck has ended after a Chester Crown Court judge sentenced him to prison for violating an order and a suspended sentence.Kelvin Mitchell, aged 69 of Lodge Lane, admitted in Chester Magistrates Court on Tuesday, April 28, to breaching a sexual harm prevention order (SHPO) that was imposed on him in 2022 for a duration of ten years.
During the hearing, Judge Michael Leeming was informed that Mitchell had broken his SHPO twice—once in 2025 and again in 2026—and that he had been given suspended sentences for each violation.
It was explained that Telegram passcodes were found in Mitchell’s emails, yet the app itself was not on his phone, indicating he had deleted it, which was prohibited by his court order.
Additionally, he had erased his internet history, another breach.
In interviews, Mitchell admitted that he had downloaded the app to chat with individuals at “Chat Tower” and would delete it after use or if he disliked the person he was engaging with.
However, the court clarified that Mitchell was fully aware of the restrictions imposed by his order.
Defence lawyer Adam Antonszkiw argued that his client had mostly complied with the court instructions and acknowledged the breach, though he did not view it as part of a pattern of ongoing offending.
When sentencing Mitchell—who stared straight ahead without making eye contact with Judge Leeming—the judge stated that Mitchell’s repeated non-compliance warranted custodial punishment.
He remarked, “You are now 69 years old with three convictions since 2022, including possession of child sex abuse images across various categories and extreme pornography.
“You were originally sentenced to eight months, with a suspended sentence for that and another for breaching the order.
“Your conduct has undermined community supervision, and your use of the Telegram app is particularly concerning because it remains unmonitored and poses a danger to the public.
“Your pattern of non-compliance is evident, as noted in the pre-sentence report.
“You also tried to lay blame on your sex offender management team for ‘giving you permission to download it.’” While Mr.
Antonszkiw rightly acknowledged that his client deserved full credit and did not believe the breach was consistent or ongoing, the judge was convinced this was a case of prolonged misconduct, involving multiple instances of downloading and deleting the app, constituting a second breach of his SHPO.
As a result of these violations, Mitchell was sentenced to 18 months in prison for his guilty plea, with an additional consecutive eight-month term for breaching the suspended sentence.
He will serve half of this term on licence.
