JULIUS DERKINTIS SENTENCED TO SIX YEARS FOR RAPE IN ABERDEEN
A man identified as Julius Derkintis has been sentenced to six years in prison after being found guilty of raping a woman while she was asleep.The incident took place at a residence on King’s Crescent in Aberdeen during June 2013.
The case was heard at the High Court in Edinburgh, where the court was presented with evidence and testimonies that ultimately led to his conviction.
Julius Derkintis, a 21-year-old Lithuanian immigrant residing on Victoria Road in Aberdeen, was accused of attacking a woman who cannot be named for legal reasons.
The assault occurred when the woman was sleeping at the time, and she later woke up to find Derkintis on top of her.
The legal proceedings revealed that Derkintis claimed the sexual encounter was consensual, but the jury was convinced by the evidence that this was not the case.
During the trial, the prosecution, led by lawyer Ian McSporran, questioned the woman about her ability to consent.
She responded, “I don’t understand how I would be able to consent if I was passed out and unconscious.
Was I in any state to give legitimate consent?
I don’t think so.” Her statement underscored the fact that she was asleep and unable to give consent at the time of the assault.
The court heard that the attack happened on June 24 of the previous year, and the woman, who also hails from Lithuania, was unaware of the assault until she woke up to find Derkintis on top of her.
The jury deliberated and ultimately convicted Derkintis of rape, recognizing that the evidence supported the charge beyond a reasonable doubt.
In sentencing, Temporary Judge Nigel Morrison QC emphasized that Derkintis showed no remorse or empathy for his victim.
He stated, “You have little insight into the impact that your crime has had on the woman.
You display no victim empathy.” The judge also noted that Derkintis had not expressed any remorse for his actions and that his lack of insight warranted a custodial sentence.
Furthermore, Judge Morrison ordered Derkintis to be placed on the Sex Offenders Register for life, reflecting the severity of the crime and the court’s stance on protecting the public from individuals who commit such offenses.
The case highlights the importance of consent and the legal consequences faced by those who violate personal boundaries, especially in cases involving sleep or unconsciousness.
