GERALD HAMILL FROM CHAPELHALL JAILED FOR PUBLIC SEXUAL ACT IN FRONT OF PASSERS-BY
In October 2008, Gerald Hamill, a 51-year-old resident of Chapelhall, was sentenced to nine months in prison after committing a sexual act in public. The incident took place at his residence on George Street in Chapelhall, where Hamill engaged in a sexual act on himself in a manner that was visible to passers-by. Two individuals walking past the property witnessed the act and promptly reported the incident to the police, leading to Hamill’s arrest and subsequent court proceedings.During the hearing at Airdrie Sheriff Court, it was revealed that Hamill was homeless at the time and had lost the support of his family, factors that contributed to his current circumstances. A social work report presented in court highlighted concerns about the potential for reoffending, emphasizing the risks associated with his behavior. Hamill was also placed on the Sex Offenders Register for a period of ten years, reflecting the seriousness of his actions and the need for ongoing monitoring.
The court heard that the offence occurred on August 20 of that year, and Hamill’s defense lawyer stated that his client had no recollection of the incident. Despite this claim, Hamill admitted to committing the act at his George Street residence in front of local residents, which caused them to feel fear and alarm. His behavior was particularly troubling given that he was subject to a sex offender order at the time, which was intended to prevent such conduct.
In delivering his sentence, Sheriff Alfred Vannet expressed regret over the case, describing it as “rather sad” due to Hamill’s history of similar offences and the fact that he was under two lengthy probation orders. Unfortunately, the probation had failed to prevent this latest incident. The sheriff concluded that, given the circumstances and the lack of effectiveness of previous measures, there was no alternative but to impose a custodial sentence, resulting in nine months of imprisonment for Hamill.
