ERIC SHAW FROM SINFIN ESCAPES JAIL AFTER CHILD ABUSE CASE IN DERBY

In a case that has shocked the community of Sinfin, Derby Crown Court heard how Eric Shaw, aged 57, was convicted of serious sexual offenses involving a nine-year-old girl.

Shaw, who formerly resided on Aviemore Way in Sinfin, pleaded guilty to two counts of engaging a child in sexual activity and one count of sexual assault.

Despite the gravity of his crimes, the court decided against sending him to prison, opting instead for a community-based sentence that includes strict supervision and rehabilitative measures.

During the sentencing, Recorder Maureen Baker emphasized that Shaw would be subject to a three-year probation order, which mandates his participation in a sex offenders' group work programme.

The judge warned Shaw that this community order could be more challenging than a prison sentence, but she believed it would serve a greater purpose in preventing future offenses.

She stated, "I think this will be tougher.

I take the view it will do greater good and make sure you do not behave like this to any other child in future." She further explained that the serious nature of Shaw’s offences, which caused significant distress to the young victim, warranted a stern response.

However, she also highlighted that Shaw could expect immediate imprisonment if he breached the terms of his probation or committed another offence.

The judge added that a custodial sentence would not have allowed him to receive the necessary treatment, and that a community order would enable Shaw to confront and manage his issues directly.

"With a community order, he is now able to grapple with his demons," she said, indicating her belief in rehabilitation over incarceration.

Prosecutor Miss Vee Monro recounted that Shaw had told his victim that the abuse should remain a secret between them and that it was "experience for you when you are older." The court was informed that the young girl now suffers from nightmares, and her mother expressed concern that the incident had altered her character.

The girl reportedly feels safer at school, which she perceives as a refuge from her trauma.

In mitigation, Clive Stockwell argued that Shaw’s initial reluctance to admit to the sexual element during a probation interview had complicated his case.

He suggested that Shaw had not been dismissive of his actions and emphasized that Shaw would not have forced the girl to testify, which contributed to his decision to plead guilty.

Stockwell also pointed out Shaw’s previous convictions for indecent exposure in 1991 and 1994, and noted that he had been subject to an order prohibiting contact with children under 16, as well as a five-year registration on the Sex Offenders’ Register.

Overall, the court’s decision reflects a focus on rehabilitation and community safety, with Shaw being given a chance to address his issues under supervision rather than facing immediate imprisonment.
