On October 9, 2022, the victim, who was heavily intoxicated and confused after a night out on Union Street, encountered Valdivieso.
Posing as a caring and trustworthy individual, he convinced her to accompany him to his home.

While she was asleep and unable to give consent, Valdivieso engaged in a series of sexual acts, including kissing her repeatedly and touching her breasts.
The assault escalated to rape, with Valdivieso continuing his misconduct even after she awoke, demonstrating a blatant disregard for her well-being and consent.
The victim, despite her trauma, summoned the courage to contact the police, which led to Valdivieso’s arrest.
His conviction earlier this year included charges of rape and supplying cannabis, highlighting a pattern of criminal behavior.

Furthermore, it was revealed that Valdivieso had violated his bail conditions by traveling to London and Edinburgh, where he intervened in a violent assault.
