DAVID BAINES FROM HESWALL JAILED OVER CHILD INDECENT IMAGES SCANDAL
In a case that has sent shockwaves through the Heswall community, 65-year-old David Baines, a prominent figure associated with Heswall Primary School, has been sentenced to 12 months in prison for possessing and viewing indecent images of children. Baines, who served as a school governor and also taught recorder at the primary school, led a double life that was described as both private and depraved by the court.On March 17 of this year, police executed a raid on Baines's residence on Shrewsbury Road in Heswall. During the search, officers discovered that Baines, who was the chairman of the school's governing body, had admitted to viewing such images. In his bedside cabinet, authorities found seven indecent colour photographs. Further analysis of his computer equipment revealed a staggering total of 11,067 images, including four videos, all categorized across the spectrum of seriousness associated with child exploitation material.
The court heard that Baines had been involved with the school for many years, during which he appeared to be a dedicated and trusted figure. He was known to teach the recorder once a week and was regarded as the unofficial photographer for the school. His role extended to participating in numerous school trips, where he interacted closely with children. Despite this outward appearance of community involvement and dedication, the court was told that Baines maintained a secret life filled with disturbing and illegal material.
Judge Graham Morrow, QC, addressed Baines directly, stating, “You abused your position of trust at that school and all those involved in the running of that school. All the parents and pupils must feel terribly let down and justifiably outraged at your behaviour.” The judge emphasized the betrayal of trust, noting that Baines’s conduct had profoundly damaged the reputation of the school and the community.
Furthermore, Baines, a father of three daughters, was assessed by a probation officer as posing a “high-risk of harm to children.” Despite his admission to viewing indecent images of children, he showed no visible emotion as he was led away to the cells following his sentencing. The court also ordered him to sign the Sex Offenders Register for a period of seven years and imposed a Sexual Offences Prevention Order that restricts his internet use for ten years.
Character references presented to the court painted a different picture of Baines. His brother, a former policeman, attested that he “had never been and never will be a danger to children.” His daughters and ex-wife also spoke highly of him, with his daughter Helen describing him as “never seen a more broken and remorseful person.”
Prosecutor David McLachlan highlighted Baines’s long-standing involvement with the school, noting that he had been a volunteer governor for approximately 14 to 15 years. “He went on many school trips and interacted with the children,” McLachlan explained. “He was a familiar figure at the school and was known to teach the recorder and serve as the unofficial photographer.”
During police interviews, Baines admitted to regularly viewing child pornography, acknowledging that he had seen such images despite knowing it was wrong. He also admitted to having an interest in girls from the age of nine but claimed he did not understand why he was attracted to such images.
Defence counsel Philip Astbury emphasized that Baines had no prior convictions and had contributed positively to the local community. He stressed that there was no evidence to suggest that Baines had acted inappropriately with any children or that his involvement with the school was motivated by his illegal interests. Astbury concluded by stating that Baines felt “genuine shame, regret, and remorse,” acknowledging that the consequences of his actions would stay with him forever.
