    In a series of disturbing criminal cases, Daniel Carlin, a resident of Ballyarnett, has been convicted and sentenced for multiple serious offences related to child exploitation and indecency. The proceedings, which took place in Derry Crown Court, reveal a troubling pattern of behavior that spans several years and involves the possession of indecent images, voyeurism, and sexual misconduct involving minors.

    In October 2013, Carlin, aged 63 at the time, was sentenced to four months in prison after pleading guilty to nine charges of creating indecent images of children. These offences occurred between August 2008 and April 2010. The court was informed that police had conducted a search of Carlin’s residence in Ballyarnett on April 8, 2010, during which they seized a variety of electronic storage devices, including video cassettes, floppy disks, CDs, and four computer towers and PCs. These items were subsequently examined, revealing that between one computer tower and a Compaq PC, a total of 67 indecent images of children had been recovered. Although Carlin had attempted to delete these images, forensic analysis by the e-crime unit managed to recover them.

    The images were classified predominantly as Level 1, indicating a lower severity, but ten images were categorized as Level 4, which is among the highest levels of indecency, just below the maximum Level 5. Further investigation into Carlin’s computer activity uncovered that he had accessed numerous pornography sites, including those featuring teenagers and young individuals. Searches related to the rights of sex offenders against anonymous allegations and instructions on how to delete data from a hard drive were also found. During a police interview in July 2011, Carlin admitted to accessing pornography, including material involving minors, and claimed that he would quickly exit any links that appeared to depict child pornography.

    As a result of these findings, Carlin was ordered to register as a sex offender for seven years and was subjected to a Sexual Offences Prevention Order (SOPO). This order prohibits him from having any unsupervised contact with children under 16, working in leisure centers, or entering facilities designated exclusively for female users. Additionally, he is restricted from using internet-enabled devices unless his search history can be monitored by a designated risk manager. The SOPO, which is valid for seven years, aims to prevent any further offending and protect vulnerable minors.

    Earlier in August 2013, Carlin had already admitted to making indecent images of children, pleading guilty to nine charges covering the period from April 24, 2008, to April 9, 2010. The court adjourned sentencing to allow for a probation pre-sentence report, and Carlin was ordered to re-register as a sex offender before being released on bail, with a subsequent court appearance scheduled for September 25.

    Further back, in June 2012, Carlin was convicted of gross indecency towards a six-year-old girl. He received a six-month prison sentence and was placed on the sex offender’s register for seven years. The offences involved acts committed over a two-year period starting in January 2006, when the girl was just six years old. Carlin, then aged 61, pleaded guilty to these charges. The case also revealed that in September 2008, Carlin had been convicted of voyeurism after being caught peering through a keyhole at the Templemore Sports Complex, where he was employed. He had watched a woman undressing in the women’s changing area. For this offence, he received a two-year probation period and was also registered as a sex offender.

    During the court proceedings, a prosecution lawyer detailed that Carlin had admitted to entering the girl’s bedroom while naked and turning her towards him, although no physical contact or threats were made. It was also disclosed that Carlin was in a relationship with the girl’s mother and sometimes stayed overnight in the family home. The girl confided in her mother about the incidents in 2010, leading to police interviews where Carlin initially denied the allegations but later admitted guilt on May 29, 2012, just before his trial was set to commence. The girl’s family expressed relief that her testimony would not be required, given Carlin’s admissions.

    Throughout the court proceedings, defense counsel Mark Reid acknowledged the trauma inflicted on the young victim and described Carlin’s actions as being at the lower end of the spectrum of sexual offences. He also highlighted the social consequences Carlin faced, including ostracism from his family and community, which had led him to live a reclusive life. Judge Stephen Fowler emphasized that Carlin’s intelligence and education should have prevented such behavior, noting that he was aware of the consequences. The judge pointed out that the victim impact statements demonstrated the profound distress caused to the child.

    In addition to the prison sentence, Judge Fowler imposed a series of strict restrictions on Carlin’s future conduct. These include a ban on unsupervised contact with children, mandatory disclosure of his convictions to any prospective employer, and a prohibition on using internet devices unless monitored by a probation officer. Upon release from prison, Carlin was ordered to cooperate with police inspections of his residence to ensure compliance with all court orders, underscoring the seriousness with which the court viewed his offences and the need to prevent any further harm.
