TRANSGENDER MAN WITH NO PENIS JAILED FOR DECEPTIVE SEX ACTS IN SCOTLAND
Carlos Delacruz, aged 35, a transgender man from Banknock near Falkirk, was convicted and sentenced to three years in prison after a court found him guilty of deceiving two women into having sex using a prosthetic erection.Both women, whose identities are protected for legal reasons, reported experiencing severe pain during intercourse and suffering from thrush following their encounters.
Delacruz, who was in separate relationships with each victim between 2013 and 2017, falsely claimed and led the women to believe he had a functioning penis.
The court heard that during their sexual relations, Delacruz wore a t-shirt with the lights off to conceal his lack of genitalia, and during one occasion, a sound similar to a condom wrapper was heard as he engaged with one woman, raising suspicion due to his hand holding at the base of a presumed penis.
After their relationships ended, the women discovered the deception: one contacted police after discovering he lacked a penis, and the other, who was left bleeding and in pain multiple times, reported extreme distress and flashbacks.
Delacruz pleaded guilty to penetrating the women without their consent with an unknown object, and the court acknowledged the harm caused, including psychological trauma, flashbacks, panic attacks, and feelings of being dirty and used.
Sheriff Stirling emphasized that Delacruz’s actions caused both physical and emotional injuries and imposed a five-year non-harassment order against both victims.
Delacruz's legal team explained he regarded the prosthetic as a part of himself and that his current long-term partner was fully aware of and consenting to his use of the prosthetic.
The court's verdict underlines the severity of his deception and assault, resulting in his incarceration and protective orders.
