In December 2019, a disturbing case emerged involving Callum Martyr, a 20-year-old man from Basildon, who was found guilty of grooming and sexually abusing a girl who was under the age of 16. The incident took place when Martyr was 18 years old, and it was revealed during court proceedings that he attempted to persuade his young victim to engage in sexual activities despite her clear discomfort and refusal.

Details presented at Basildon Crown Court indicated that Martyr had been paying the girl compliments, which she described as making her feel loved. However, the situation took a darker turn when he tried to physically touch her, an act that upset her greatly, leading her to push him away. The court heard that the girl was distressed by Martyr’s inappropriate advances, which she did not consent to, and she expressed her discomfort during the incident.

The case came to light after police discovered inappropriate messages on Martyr’s phone, which prompted a thorough investigation. Following this, Martyr, who resided in Wickhay, Basildon, was formally charged with serious sexual offenses. He admitted to one count of serious sexual assault and another of sexual assault by touching, but he avoided immediate imprisonment.

During the mitigation phase of the trial, it was brought to the court’s attention that Martyr might have had limited mental capacity compared to others his age. Although this was not used as a justification for his actions, it was considered relevant. Christopher Martin, representing Martyr, explained that he suffers from attention deficit hyperactivity disorder (ADHD) and has “more limited cognitive ability” than most individuals his age. Martin also noted that Martyr struggles with forming and maintaining relationships, and his educational development has been adversely affected.

Judge Samantha Leigh addressed Martyr directly, emphasizing the seriousness of his actions. She stated, “It was quite clear that you knew of her age and when the sexual touching took place she said ‘no’ and that she didn’t want it. She could not give consent, and you would know that a physical relationship with a pre-teen girl was inappropriate.”

Ultimately, Martyr was sentenced to two years in prison, but the sentence was suspended for two years, meaning he would not serve time unless he committed another offense within that period. Additionally, he was ordered to complete 200 hours of unpaid work and 60 hours of rehabilitation activities. A restraining order was also issued against him, prohibiting any contact with the victim to ensure her safety and well-being moving forward.
