FOCHABERS MAN ADMITS ASSAULT AND FACES SUPERVISION AFTER DAMAGING PARTNER’S FACE
A resident of Fochabers has been placed under supervision after admitting to attacking his former partner and forcibly removing a piercing from her face.Allan Burgess, aged 47, initially denied any wrongdoing and claimed he was a victim of abuse himself but later altered his plea on the day of trial at Elgin Sheriff Court.
The assault occurred in April of the previous year after Burgess and the victim went out for the night and returned home, continuing their drinking.
An argument erupted, with Burgess calling the police to report being assaulted with a watch thrown at him, but he ended the call before police arrived.
The court heard that Burgess then grabbed the woman by her hair, pushed her onto the floor, and struggled with her.
During the struggle, he pulled out her nose ring, injuring her face.
The victim managed to escape and ran to her bedroom, while Burgess packed a bag and left the premises.
Police attended the scene, observed cuts under her right eye and redness on her scalp, and Burgess reported with a cut to his eyebrow and scratches on his nose.
Burgess pleaded guilty to assault, which involved grabbing his partner by her hair, pushing her, and pulling her nose ring, resulting in her injury.
His defense argued that the argument was initiated by the complainant, citing alcohol consumption and the throwing of items at Burgess.
The court ultimately sentenced Burgess to be under supervision for six months.
